FedEx sues for full refund of IEEPA tariffs after Supreme Court ruling

Feb 24th 2026

FedEx filed a suit Monday in the U.S. Court of International Trade seeking repayment of all tariffs it paid under the overturned IEEPA orders, saying the company was harmed when the duties were imposed on its imports.

  • FedEx asked for a full refund of IEEPA duties it paid while importing goods into the United States.
  • The Supreme Court ruled Friday that President Trump exceeded his authority when he used IEEPA to impose broad tariffs.
  • FedEx says it paid those duties as the importer of record and therefore suffered injury from the orders.
  • Executives warned the tariffs could cut FedEx earnings by as much as $1 billion in fiscal 2026 and stressed harm to customers including small exporters.
  • FedEx is one of several major companies, including Costco, that have filed or are preparing refund suits in the Court of International Trade
