Judge orders customs to reprocess entries after Supreme Court struck down Trump tariffs

Mar 5th 2026

A federal judge has ordered Customs to finalize or correct duty calculations for imports without the emergency tariffs the Supreme Court struck down, advancing but not completing the process for major tariff refunds.

  • Senior Judge Richard Eaton directed U.S. Customs and Border Protection to complete or redo liquidation of affected import entries without the emergency tariffs the Supreme Court invalidated.
  • The order follows the Supreme Court's 6-3 decision that most of the emergency tariffs exceeded presidential authority under a 1977 statute.
  • The ruling moves the refund process forward but does not immediately release money to importers.
  • CBP says it still needs review periods to ensure no other duties, taxes, fees, or customs violations apply before paying refunds.
  • More than 1,000 companies have filed claims and tens of billions of dollars in tariff payments are potentially at stake.
